Terms Conditions & Returns

Ordering Procedure:
All orders must be processed through the Touch New Zealand Online Store and paid for in full, including shipping and handling costs. All prices are listed in New Zealand Dollars.

We are only able to ship to New Zealand addresses.

Delivery:
Timely delivery of your order is our top priority and we aim to dispatch your order the next business day after ordering and for you to obtain your product(s) within 5 business days of order. If for any reason we anticipate a delay in dispatching your order beyond 10 business days, we will contact you to advise.

Should your order note arrive within 10 business days please contact us and we will track the courier consignment number.

Please contact us immediately if any items are damaged in transit and/or if we have under or over supplied you with product.

All balls will be supplied deflated.

Product Returns:
If for any reason you wish to return any products, please contact marketing@touchnz.co.nz or phone 0800 TouchNZ for approval. We reserve the right to replace, refund or credit your account for any returned product.

Goods returned for reasons other than manufacturing defect must be returned within 15 working days to the distributor, in original packaging and in saleable condition. Damaged or used product will not be accepted for credit or exchange. Please provide proof of purchase with all returns.

Freight costs to return and re-send any replacement items may be buyers’ responsibility unless otherwise agreed to by Touch New Zealand. You may be credited or refunded some or all freight costs if we are satisfied that in our opinion it is our responsibility to do so.

Touch NZ Credit Card Information Policy:

Touch NZ uses the DPS Payment Express Payment Gateway for its online credit card transactions. DPS processes online credit card transactions securely for thousands of merchants globally, providing a safe and secure online payment service.

Terms and Conditions for MyCard

 

 

By registering for a Touch New Zealand MyCard you agree that you are accepting and are bound by the following terms and conditions:

 

1.         General

 

1.1          The MyCard Club (“MyCard”) and the Touch New Zealand website (www.touch.co.nz) (“the Website”) are owned and operated by Touch New Zealand Incorporated and Turbo Touch Limited (jointly referred to as “TNZ”).

 

1.2          Your MyCard membership is conditional upon your express agreement to, acceptance of and compliance with these terms and conditions, as well as agreement to and compliance with any other terms and conditions put forward by TNZ in relation to the MyCard or related services.

 

1.3          By becoming a member of the MyCard scheme, you are expressly accepting these terms and conditions.

 

1.4          TNZ reserves the right to amend these terms and conditions without prior notice.  Any amendments made will be updated on the Website and we recommend that you check the terms and conditions regularly.

 

1.5          TNZ reserves the right to change any services, competitions, rewards, rules, or content of MyCard and MyCard membership at any time without prior notice.

 

1.6          TNZ makes every effort to ensure that the information contained on the Website is accurate and complete, however, TNZ does not guarantee such accuracy and completeness and will not be held responsible for any errors.

 

2.   Membership Conditions

 

2.1          Notwithstanding any other clause in these terms and conditions, in the event that any of the following conditions of membership are breached, TNZ reserves the right to refuse or terminate your membership to MyCard.

 

2.2       To be eligible to become a MyCard member:

 

(a)     (i)   you must be 18 years of age or over; or

(ii)   in the event that you are less than 18 years of age you must have the permission of your parent or guardian to join the MyCard scheme; and 

 

(b)      you must be a resident of New Zealand; and

 

(c)      you must complete the registration process as set out by TNZ; and

 

(d)      you must pay the membership fee in the amount and manner set out by TNZ.

 

2.2          You are only eligible to register once for MyCard and you must not register for MyCard on behalf of any other person.

 

2.3          Your MyCard is personalised to you and is not transferrable.  Nor are any of the services, discounts or offers available through the MyCard scheme, unless expressly stated by TNZ or any MyCard partner. TNZ and any of TNZ’s partners or associates under the MyCard scheme reserve the right to require secondary identification prior to providing you with any benefit of MyCard membership. Failure to produce such identification may result in TNZ or the relevant partner or associate refusing to provide you with the membership benefits in question.

 

2.4          Notwithstanding any other clause in these terms and conditions, TNZ reserves the right to refuse membership or renewal of membership to any person at their sole discretion.

 

2.5          The personal information which you supply to us in your MyCard application must be true and correct to the best of your knowledge.  In the event that any of the information changes, you will advise us of the charges as soon as possible by submitting a MyCard Change of Details form that can be found at www.touchnz.co.nz/mycard.

 

3.   Membership

 

   3.1       MyCard membership is an annual membership which will run from the date of issue of the membership card for a period of 12 months.  Benefits will be available to you during this period, and in the event that the membership is renewed, during any renewal period.

 

3.2          On completion of membership details and payment of the membership fee, a card will be issued to an eligible person.  On renewal of membership and payment of a renewal fee, a new card will be issued to the MyCard member.

 

      3.3       A list of benefits for MyCard members will be made available at the Website and will be updated from time to time.

 

3.4       MyCard is not a credit card, a cash card, loyalty card or any more of official identification.

 

3.5  The MyCard issued to the MyCard member remains the property of TNZ.

 

3.6          Any offer or discount available under the MyCard can only be used once in conjunction with that offer or discount unless expressly stated.  The offer or discount may only be used by the member and is not transferrable. 

 

3.7          In the event of the loss of your MyCard please report this as soon as possible to TNZ by phoning 0800 TOUCHNZ or by sending an email to shop@touchnz.co.nz.

 

4.   Account Password

 

You must keep your account password confidential at all times.  TNZ are not liable for any loss or damage arising out of the unauthorised use of your username and password. In the event that you believe your password has become compromised in any way please contact us immediately at email info@touchnz.co.nz so that we can take appropriate action.You may change your password at any time by visiting wwwshop.touchnz.co.nz/.

 

5.   Communications From Us

 

5.1  By joining the MyCard Scheme, you are consenting to the emails relating to goods and services provided by or through TNZ being sent to you at the email address supplied by you to TNZ[MSOffice1] [b2] .

5.2          In the event that you supply your personal information or any details to a partner in the MyCard scheme, you are doing so at your own risk and such disclosures will be governed by the appropriate partner’s privacy policies and terms and conditions.

 

6.   Online Shopping

              

6.1          Any online shopping undertaken in conjunction with the MyCard is subject to the separate Online Shopping terms and conditions found on the Website.

 

7.   Promotions

              

7.1          TNZ takes no responsibility for and accepts no liability in relation to the quality of any product purchased or any services provided as part of any promotion by any of the suppliers or partners to MyCard.

 

 

8.    Competitions

 

8.1          MyCard competitions run by TNZ will be governed by separate terms and conditions applicable to each competition. These terms and conditions will be available to members prior to entry into the competition[b3] .

 

8.2       TNZ employees and their family members, and TNZ affiliates, clients, agents, suppliers and their immediate family are not eligible to enter any MyCard competitions.

 

9.    Privacy Policy Obligations

10.Copyright

 

      10.1     The copyright in any content or material relating to MyCard or Website or in any TNZ or MyCard communication is protected by New Zealand and international copyright law.

 

   10.2     The TOUCH NEW ZEALAND Logo, TOTAL TOUCH Logo and TURBO TOUCH are trade marks owned by Touch New Zealand Incorporated.

 

      10.3     Any intellectual property owned by TNZ may not be copied, reproduced, published, stored in a retrieval system, altered or otherwise used in any form or by any means, in whole or in part, without the prior written approval of TNZ or the prior written approval of the relevant intellectual property owner.

 

11.Indemnity

 

      11.1     You indemnify TNZ and any related company, employee, contractor or agent against any loss, liability, damage, cost or expense that TNZ or any of its related entities suffers, whether directly or indirectly, as a result of your membership to or use of MyCard, any breach by you of these terms and conditions, or any claim by a third party relating to your membership or use of MyCard or any breach by you of these terms and conditions.

 

12. Severance

 

      12.1     If any part of these terms and conditions violate or are prohibited by any applicable law or regulation it will be treated as amended or deleted so that it conforms to such law or regulation without amending or deleting any other term or condition.

 

13.Governing Law

 

      13.1     These terms and conditions are governed by and construed in accordance with the laws of New Zealand and are subject to the jurisdiction of the courts of New Zealand.
